The Collection/Foreclosure Paralegal supports the attorney in handling substantive legal matters and ensures compliance with the Fair Debt Collection Practices Act, as well as Florida’s Condominium Act, Cooperative Act, Homeowners' Association Act, and other relevant state laws.
DUTIES/RESPONSIBILITIES:
Association Actions
- Understand and comply with the provisions of the Fair Debt Collection Practices Act and related state laws.
- Communicate with delinquent owners via phone, email, and letter correspondence respectfully and professionally.
- Process payments from owners and prepare balance due letters, payoff letters, and estoppels.
- Review pre-collection notices from clients, ledgers, back-up documentation, etc.
- Prepare Notice of Intent to Lien Letters, Notice of Intent to Foreclose letters, and Liens.
- Prepare and generate the complaint packages.
- Prepare and generate all foreclosure pleadings.
- Prepare and generate Stipulations for Settlement, if necessary, including the Order Ratifying the Stipulation.
- Prepare and generate the Motion for Summary Judgment, including the affidavit of indebtedness and the affidavit of costs. The affidavit of attorney's fees will be initially prepared and generated by the Team Assistant but will be completed by the Paralegal by confirming that the information is correct and by adding the estimated attorney's fees incurred to finish out the action.
- Prepare and generate all Notices of Hearing.
- Instruct Team Assistants with various tasks.
- Prepare and generate the Final Judgment, including the Notice of Sale.
- Prepare cover letter to the judge.
- Prepare the hearing folder for the attorney to take to the hearing.
Bank Actions
- Pull Mortgage/Satisfaction Search.
- Prepare Answer/Affirmative Defenses.
- Prepare and generate any Motions for Case Management Conference, Notice of Trial, and Motions to Reschedule Sale.
- Prepare and generate all Notices of Hearing.
Bankruptcy Actions
- Prepare Notice of Appearance and Request for Service.
- Prepare Exhibit to Proof of Claim.
- Prepare Notice of Change in Post-Petition Amounts.
REQUIRED SKILLS/ABILITIES:
- Proficient in Microsoft Office Suite (Word, Excel, Outlook) and internet.
- Strong written and verbal communication skills.
- Excellent customer service skills.
- Problem-solver with timely decision-making abilities.
- Team-oriented and willing to assist others as needed.
- Highly organized and able to multitask in a fast-paced environment.
- Analytical, reliable, detail-oriented, and deadline-driven.
EDUCATION AND EXPERIENCE:
- High School Diploma required; Bachelor’s Degree preferred.
- 2 or more years of experience.
